Terms of Service

Last updated: April 2026

1. Platform Role

Funeral Fundraiser is an independent fundraising intermediary platform. We facilitate the secure collection of donations from the public and the disbursement of those funds to verified fundraiser organizers. We are not a funeral home, financial institution, or registered charity. We do not provide funeral services and are not responsible for the delivery of any funeral services. All payments on this platform are processed by Stripe, Inc. By using this platform, you also agree to Stripe's Terms of Service, available at https://stripe.com/legal.

2. Definitions

These terms are used throughout this agreement and apply to everyone who interacts with Funeral Fundraiser:

Organizer / Beneficiary — The person who creates and manages a fundraiser, and who is also the direct beneficiary of the funds raised. Fundraising on behalf of a third-party beneficiary is not permitted on this platform. You may create a fundraiser only if you are (i) the person legally responsible for arranging, or otherwise bearing the financial cost of, the deceased's funeral, burial, cremation, or memorial services, and (ii) the person in whose name the Stripe Connected Account that receives donated funds is held. The Organizer is responsible for the accuracy of all information on the fundraiser page, including the identity of the deceased, the stated purpose of the fundraiser, and how funds will be used.

Donor — Any person who contributes funds to a fundraiser through the platform. Donors give voluntarily and acknowledge that donations are not tax-deductible and are generally non-refundable once processed.

Funeral Home Partner — A licensed funeral service provider that has entered into a partnership agreement with Funeral Fundraiser. Funeral Home Partners may be listed on fundraiser pages and may offer discounts or services to families using the platform. Funeral Home Partners are independent businesses and Funeral Fundraiser is not responsible for their services. Funeral Home Partners are not the beneficiary of donated funds; donations are paid to the Organizer's Stripe Connected Account, and the Organizer applies those funds to the services contracted with the Funeral Home Partner off-platform.

By creating a fundraiser, you attest that (a) you are the Organizer and the sole direct Beneficiary of the donated funds; (b) no other person will receive or control the donated funds except through payment by you, off-platform, to a licensed funeral service provider for services rendered for the named deceased; and (c) you have authority to represent the deceased's arrangements in this capacity. Misrepresentation of these attestations is a material breach of these Terms and grounds for immediate suspension, clawback of funds to donors, and referral to our payment processor and to law enforcement.

3. Identity Verification

All fundraiser organizers and beneficiaries are required to complete identity verification before receiving any funds. This process is administered by our payment processor, Stripe, and may require you to provide your full legal name, address, date of birth, government-issued ID, and bank account information. Donations received while your verification is pending will be held securely in the Funeral Fundraiser platform account. We will notify you of any outstanding verification steps required to release your funds. Once verification is approved by Stripe, your funds will be transferred promptly in accordance with our disbursement schedule. Funeral Fundraiser cannot release funds to any account that has not completed verification, and we are not liable for any delay in access to funds caused by incomplete or unsuccessful verification.

4. Platform Fee

Funeral Fundraiser charges a 3.5% platform fee. Standard payment processing fees apply. This fee is deducted automatically at the time of each transaction. There are no upfront costs, monthly fees, or charges for creating or closing a fundraiser.

5. Fund Disbursement

Donations are processed through Stripe's payment infrastructure and collected into the Funeral Fundraiser platform account. Funds are held in the platform account until the Beneficiary's identity verification (KYC) has been reviewed and approved by Stripe. Once verification is complete, funds are transferred to the Beneficiary's verified Stripe connected account, less our 3.5% platform fee and applicable Stripe processing fees. Payouts from the Beneficiary's Stripe account to their connected bank account typically occur within 2 business days of each transfer, subject to Stripe's payout schedule. Funeral Fundraiser does not escrow or pool funds for investment or any purpose other than pending disbursement to verified accounts. We are not a bank or financial institution. All fund movement is governed by Stripe's payment infrastructure and their applicable terms of service. Funds must be withdrawn to your connected bank account within 120 days of your first donation. If funds are not withdrawn within this period, they may be refunded to donors or handled in accordance with applicable law. You will be responsible for working with the appropriate authority to recover any escheated funds.

6. No Responsibility for Funeral Services

Funeral Fundraiser is not a party to any agreement between a family and a funeral home. We are not responsible for the quality, delivery, pricing, or availability of any funeral services. Any funeral home contribution or discount displayed on a fundraiser page is offered by the funeral home at their sole discretion and is not guaranteed by Funeral Fundraiser.

7. Refunds and Disputes

Because donations are transferred to the fundraiser organizer as they are received, Funeral Fundraiser cannot guarantee refunds once a donation has been processed. If you believe a fundraiser is fraudulent, misleading, or violates these Terms, please contact us immediately at support@funeralfundraiser.com. We will investigate and work with our payment processor to determine the appropriate course of action. Funeral Fundraiser reserves the right to issue refunds, suspend payouts, or close fundraisers at its sole discretion where fraud or misuse is identified.

8. Not a Registered Charity

Funeral Fundraiser is a for-profit fundraising platform, not a registered charity or non-profit organization. Donations made through this platform are not tax-deductible. We do not provide charitable tax receipts.

9. Acceptable Use

9.1 Platform-Specific Prohibitions

You agree to use this platform only for legitimate fundraising related to funeral, burial, cremation, memorial, and end-of-life expenses. You must not:

  • Create a fundraiser for a person who has not passed away
  • Misrepresent your identity or relationship to the deceased
  • Use funds raised for purposes unrelated to end-of-life expenses without disclosure to donors
  • Impersonate another person or organization
  • Create multiple fundraisers for the same individual
  • Use this platform for any unlawful purpose

Fraudulent fundraisers will be removed immediately, reported to applicable authorities, and may result in permanent account suspension. Funeral Fundraiser reserves the right to suspend or remove any fundraiser at any time, for any reason, with or without notice.

9.2 Prohibited Activities — Payment Processor Compliance

Funeral Fundraiser uses Stripe as its payment processor. By using our platform, you agree not to create, participate in, or use any fundraiser or donation for any purpose that appears on Stripe's Prohibited and Restricted Business List, which includes but is not limited to:

  • Fraudulent, deceptive, unfair, or predatory activity of any kind
  • Money laundering, terrorist financing, or the evasion of sanctions
  • Activity that is illegal under applicable federal, provincial, state, or local law
  • Investment or financial services including securities, swaps, futures, binary options, pyramid schemes, multi-level marketing, or any arrangement offering a financial return to the donor
  • Lending, credit repair, debt consolidation, or bail-bond services
  • Gambling, lotteries, sweepstakes, fantasy sports with entry fees, or other games of chance
  • Adult content, adult services, escort services, or any sexually explicit material
  • Firearms, ammunition, weapons, explosives, or related components
  • Controlled substances, recreational or prescription drugs sold outside regulated channels, drug paraphernalia, tobacco, e-cigarettes, vaping products, cannabis, or CBD
  • Counterfeit, stolen, or unauthorized goods; intellectual property infringement
  • Unregistered charitable solicitation; donations to unregistered political campaigns or political action committees
  • Human trafficking, forced labor, or exploitation of minors in any form
  • Hate speech, incitement of violence, or content targeting protected classes
  • Malware, surveillanceware, credential harvesting, hacking or security-circumvention services
  • Virtual currency, cryptocurrency exchange, crypto mining, or any token issuance
  • Any other activity identified by Stripe as prohibited or restricted on its then-current Prohibited and Restricted Business List, available at https://stripe.com/legal/restricted-businesses

If Funeral Fundraiser becomes aware that a fundraiser, donor, or user is engaged in any of the above activities, we will suspend the fundraiser, refund outstanding donations where practicable, cooperate with Stripe and applicable authorities, and terminate the user's access to the platform.

9.3 Sanctions and Jurisdictional Restrictions

You may not use Funeral Fundraiser — as a fundraiser organizer, beneficiary, donor, or partner — if you are:

  • Located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive economic sanctions administered by the Government of Canada, the Office of Foreign Assets Control of the U.S. Department of the Treasury ("OFAC"), the United Nations Security Council, the European Union, or the United Kingdom. This currently includes Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine.
  • Identified on any sanctions list maintained by the Government of Canada, OFAC (including the SDN List), the UN Security Council, the EU, or the UK (including the HM Treasury consolidated list).
  • A person or entity otherwise prohibited by applicable sanctions or export-control laws from receiving financial services.

You represent and warrant that neither you, nor any beneficiary, donor, or other party associated with your fundraiser, is a sanctioned person or located in a sanctioned jurisdiction. You agree to promptly notify us if your sanctions status changes.

As an additional platform-level control, Funeral Fundraiser blocks incoming requests at our edge network from IP addresses resolving to any of the jurisdictions named above (Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine). Requests from these jurisdictions receive an HTTP 451 response and cannot initiate a fundraiser, a donation, or any other transaction on the platform. This geoblock is layered on top of, and does not substitute for, Stripe's identity verification and sanctions screening of every Connected Account. We reserve the right to suspend or terminate any fundraiser, refuse or reverse any donation, and report activity to Stripe or applicable authorities if we determine, in our sole discretion, that continued service would violate applicable sanctions or export-control laws.

9.4 Enforcement

Violation of this Acceptable Use Policy may result in immediate suspension of the fundraiser, reversal or refund of donations, closure of the beneficiary's Stripe Connected Account, permanent ban from the platform, and referral to Stripe or law enforcement. Funeral Fundraiser may take any of these actions without prior notice where we determine it is necessary to protect donors, beneficiaries, our platform, or Stripe.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Funeral Fundraiser, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this platform. Our total liability to you for any claim arising under these Terms shall not exceed the platform fees collected on your fundraiser in the 30 days prior to the event giving rise to the claim.

11. Modifications to Terms

Funeral Fundraiser reserves the right to update these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised date. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in Wyoming.
